Archer Aviation (ACHR) 8-K: Trade-secret claims narrowed in court (Oct 2, 2026)

Item 7.01 Regulation FD Disclosure. On September 29, 2026, the United States District Court for the Northern District of California (the "Court") ruled on the parties motions to dismiss in Joby Aero, Inc. v. Archer Aviation Inc., et al., Case No. 5:25-cv-10703-SVK (N.D. Cal.), which the Company previously disclosed. The Court narrowed the claims asserted against the Company and its employee, dismissing certain trade-secret and contract-related claims, with leave to amend in some cases, while allowing other claims to proceed. The Court also dismissed, without leave to amend, the Company s counterclaims against Joby Aero, Inc. and Joby Aviation, Inc. in regards to allegations of violations of the Lanham Act and California s Unfair Competition Law.
